Afterdark
Terms of use
The short version
Afterdark deals prompts to a group of consenting adults in the same room. That's the whole product. It suggests; it never instructs, supervises, or vouches for anyone at your table.
Everything that happens after a card appears is between the people in the room, decided by them, and their responsibility. Every prompt is voluntary, every player can pass or stop the night at any moment, and nobody needs a reason.
You must be 18 or older. Play only with adults who have agreed to play. Pass is always free, and stop always means stop.
By downloading or using Afterdark you accept these terms. If you don't accept them, don't use the app.
Who can use Afterdark
Afterdark is an adults-only app. By using it you confirm that:
- You are 18 years of age or older — and if the age of majority where you live is higher than 18, that you have reached it.
- Everyone else in your session is also an adult who has agreed to play.
- You have the legal capacity to enter into these terms, and using the app is lawful where you are.
The app asks you to confirm your age before the bolder heat levels unlock. That confirmation is a promise you make to us. We have no way to verify it, and we rely on it — confirming falsely is a breach of these terms and ends your right to use the app.
Never let a minor use Afterdark, play in the presence of a minor, or involve a minor in any part of a session, in any way.
What Afterdark is — and isn't
Afterdark is a social party game. It deals cards with suggestions on them: things to say, to ask, to guess, to do together. The engine chooses those cards from what the people at the table have said they're comfortable with.
It isn't: advice, therapy, coaching, a relationship service, a medical or health product, a dating or matchmaking service, or a way to meet anyone new. There are no strangers on Afterdark — it only ever connects devices that already share a room code.
A card is a suggestion, not an instruction. Nothing the app deals obliges anyone to do anything. You are solely responsible for what you choose to do, for how you treat the people around you, and for complying with the law where you are.
Consent runs the night
This is the part we care most about, so we'll be plain about it.
- Participation is voluntary, always. Every activity the app suggests requires the ongoing, freely given agreement of every person involved — before it starts and for as long as it lasts.
- Consent can be withdrawn at any moment, by anyone, for any reason or none. Someone changing their mind halfway through is not a rule violation; it's the rule working.
- Pass is free and always available. No penalty, no forfeit, no "drink instead", no shaming. If you don't want a card, pass it and take the next one.
- Anyone can stop the game. Not just their turn — the whole night. Put the phone down and it's over.
- Your settings are yours. Adjust your comfort level, your pairing choices or your drink opt-in whenever you like; changes apply from the next card onward.
The app can enforce the settings people give it. It cannot see the room, read tone, notice hesitation, or know whether someone said yes because they meant it or because everyone was watching. That judgement is yours and it never transfers to us. Watch the people you're playing with. If a prompt is wrong for your group, pass it — that's what the button is for.
Never use Afterdark to pressure, coerce, trick, or shame anyone into anything, and never involve a person who has not agreed to take part.
Drinks are optional
Afterdark works completely without alcohol, and most groups play it that way. Drink prompts only ever reach players who have opted in.
- Opt in only if you are of legal drinking age where you are, and only if drinking is lawful and safe for you.
- Never drink and drive. Arrange how everyone gets home before the night starts.
- Know your limits, mind your medication and your health, and keep water on the table. Nobody has to match anyone else's pace.
- Never pressure another person to drink, and never opt someone in on their behalf.
- Consent given by someone too impaired to give it isn't consent. If the room has had a lot to drink, stop the game.
The app cannot tell how much anyone has had. That's on the people in the room.
Safety and your own risk
You use Afterdark voluntarily and you accept the risks that come with it — physical, emotional, and social. Some prompts involve movement, contact, or saying true things out loud, and any of those can go wrong between real people.
Use common sense. Clear the space around you. Don't attempt anything physical you aren't fit for. Don't play with anyone you don't trust. Consider your relationships, your health and your privacy before you begin, and think about whether the room is one where an honest answer is safe.
To the fullest extent the law allows, you assume the risk of taking part, and you agree that we are not responsible for what you or anyone else in your session chooses to do.
Things you must not do
- Use Afterdark with, around, or in any way involving a minor.
- Use it with any person who has not consented to take part, or to pressure, coerce or shame anyone.
- Harass, threaten, intimidate, or abuse another player, on or off the app.
- Break the law — anywhere, in any way, using the app or during a session.
- Record, photograph, screenshot, or share what happens in a session without everyone's agreement.
- Copy, extract, scrape, resell or redistribute Afterdark's card content, or build a competing product from it.
- Reverse engineer, decompile, tamper with, or attempt to bypass the age gate, the consent rules, the heat limits, or the subscription checks.
- Attack, overload, or interfere with our servers, or try to reach another player's private data.
- Use automated tools, bots, or modified clients to access the service.
Breaking any of these ends your right to use Afterdark immediately.
Refunds
Apple handles all payments for Afterdark, which means Apple handles all refunds. We cannot issue one, reverse a charge, or see your payment details.
Request a refund at reportaproblem.apple.com, under Apple's own terms and policies. If you're a consumer in a place that gives you a statutory right of withdrawal or cancellation, that right still stands — nothing here takes it away.
Your licence to use the app
Afterdark is licensed to you, not sold. The base licence is Apple's standard Licensed Application End User Licence Agreement, which applies to every app distributed through the App Store and forms part of your agreement with us.
These terms supplement that EULA. Where the two say different things about the same subject, these terms apply between you and us, except where Apple's EULA or App Store rules require otherwise.
Under that licence you get a personal, non-exclusive, non-transferable, revocable right to use Afterdark on Apple devices you own or control, for your own non-commercial enjoyment. Apple is not a party to these terms and has no responsibility for the app or its content, but Apple and its subsidiaries are third-party beneficiaries of them and may enforce them against you.
Our content
Afterdark — the app, the game engine, the card content, the name, the wordmark, the visual design — belongs to Ozgur Cinkilic and is protected by copyright and other intellectual property laws. Nothing in these terms transfers any of it to you.
What happens in your living room is yours. The display name you type, the answers you give, the night you have: we don't claim any of it, and we don't keep any of it.
Availability and changes
We'd like Afterdark to be available whenever you want to play, but we can't promise it. Servers go down, providers have outages, phones update, and a small app run by one person will occasionally be offline.
We may add, change, or remove features and card content over time, and we may suspend or discontinue the service. If we discontinue it while you hold an active paid subscription, we'll say so in the app and you can cancel; Apple handles any refund of the unused part.
We may update these terms. When we do, the effective date at the top changes and material changes are announced in the app. Continuing to use Afterdark after a change means you accept the updated terms; if you don't, stop using the app and cancel any subscription.
No warranties
To the fullest extent permitted by law, Afterdark is provided "as is" and "as available", without warranties of any kind, whether express or implied — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We don't warrant that the app will be uninterrupted, error-free, or secure, that the content will suit your group, or that using it will produce any particular outcome for your night, your relationships, or anything else.
Some places don't allow these exclusions. Where that's true, they don't apply to you.
Limits on liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, goodwill, or opportunity, arising out of or connected to your use of Afterdark.
We are not liable for what you or anyone else in your session chooses to do — including any physical injury, emotional harm, embarrassment, damage to a relationship, or dispute between players. The app suggests; people decide.
Where liability cannot be excluded, our total liability to you for any claim relating to Afterdark is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or 50 USD.
Nothing here limits liability that the law does not allow to be limited — including liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you're a consumer, your mandatory statutory rights are unaffected.
Ending access
You can stop using Afterdark at any time. Delete your account in the app to erase your record, and cancel any subscription in your Apple ID settings — deleting the account doesn't cancel the billing, because Apple owns billing.
We may suspend or end your access if you breach these terms — in particular the age requirement, the consent rules, or the prohibited uses — or if we're required to by law. The sections that should outlive the agreement (our content, disclaimers, liability limits, governing law) survive it.
Governing law and your local rights
These terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Türkiye have jurisdiction over disputes arising from them.
That said: if you're a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you can bring proceedings in your local courts where the law gives you that right. Nothing in this section takes away a consumer right that your local law says cannot be taken away.
General terms
Severability. If any part of these terms turns out to be unenforceable, that part is trimmed to the smallest extent needed — or removed — and the rest stays in force.
No waiver. If we don't enforce something straight away, we haven't given up the right to enforce it later.
Whole agreement. These terms, Apple's standard Licensed Application EULA, and our privacy policy are the entire agreement between you and us about Afterdark.
Transfer. You may not transfer your rights under these terms. We may transfer ours if the app changes hands, provided your rights are not reduced.
